SHIPPING, DELIVERY & LOGISTICS TERMS AND CONDITIONS

These Shipping, Delivery & Logistics Terms and Conditions ("Shipping Terms") form part of the Arya Marketplace Terms and Conditions. This document sets out the shipping policy that apply to all orders placed on the Arya Marketplace platform ("Platform"). BY PLACING AN ORDER ON THE PLATFORM, YOU ("BUYER" OR "SELLER") ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE SHIPPING TERMS.
1. PLATFORM ROLE & LEGAL STATUS
1.1. Arya Marketplace ("Arya", "we", "us", "our") operates solely as a marketplace facilitator and logistics coordinator.
1.2. Arya: i. Does not act as a carrier, freight forwarder, insurer, customs broker, or warehouse operator ii. Does not take title to, possession of, or ownership of any goods iii. Does not guarantee delivery timelines
1.3. All transportation services are provided by independent third-party logistics providers selected by the Buyer at checkout.
2. BUYER-SELECTED LOGISTICS PROVIDERS
2.1. At checkout, the Buyer is presented with one or more approved third-party logistics providers ("Logistics Providers").
2.2. The Buyer has sole discretion to: a) Select a preferred Logistics Provider b) Accept or decline optional insurance where offered c) Accept the applicable shipping rates, service levels, and insurance terms of the selected provider
2.3. Once a Logistics Provider is selected, the Buyer is deemed to have accepted: a) The Logistics Provider's shipping terms b) The applicable insurance structure (mandatory or optional) c) The allocation of risk associated with that selection
2.4. Arya shall not be liable for consequences arising from the Buyer's selection.
3. SELLER SHIPPING OBLIGATIONS
3.1. The Seller is responsible for: a) Proper packaging suitable for the nature, weight, and fragility of the goods b) Accurate product description, quantity, and specifications c) Timely dispatch in accordance with the confirmed order d) Providing accurate pickup and contact details
3.2. Failure to comply may result in delays, disputes, penalties, suspension, or cancellation.
4. ORDER PROCESSING TIME
4.1. All orders placed before 2:00 PM (Monday to Friday), will be processed on the same day. Orders placed after 2:00 PM will be processed on the next business day. Orders placed during weekends or public holidays will be processed on the next working day, subject to the seller's availability and operational capacity. Order dispatch time is based on the Seller's Lead time as indicated in their product information on the platform.
5. INSURANCE COVERAGE
5.1. MANDATORY INSURANCE
5.1.1. Some Logistics Providers include mandatory cargo insurance as part of their shipping rate.
5.1.2. Where insurance is mandatory: a) Coverage is automatically applied b) Claims for loss or damage are governed exclusively by the Logistics Provider's insurance terms c) Arya may assist with coordination but does not underwrite or guarantee claims
5.2. OPTIONAL INSURANCE
5.2.1. Some Logistics Providers offer optional cargo insurance.
5.2.2. Where insurance is optional: a) The Buyer is clearly presented with the option at checkout b) The Buyer may elect to accept or decline coverage
5.3. DECLINING OPTIONAL INSURANCE – RISK TRANSFER
5.3.1. Where optional insurance is declined: a) All risk of loss, damage, delay, theft, or deterioration transfers fully to the Buyer b) The Buyer waives any claim against Arya for shipping-related loss c) Arya shall bear no liability for uninsured shipments
5.3.2. This risk transfer applies, except where prohibited by applicable law.
6. RISK & LIABILITY TRANSFER
6.1. Unless otherwise stated by the selected Logistics Provider: a) Risk transfers to the Buyer upon dispatch where insurance is declined b) Risk transfers to the Buyer upon confirmed delivery where insurance is included c) Arya does not assume risk at any stage of transit
6.2. Arya's involvement does not constitute assumption of carrier liability.
7. SHIPPING COSTS & PAYMENT
7.1. Shipping fees are calculated based on: a) Weight and volume b) Distance and destination c) Selected Logistics Provider d) Insurance inclusion or exclusion
7.2. All shipping fees must be paid before dispatch unless expressly agreed otherwise.
7.3. Arya reserves the right to re-quote shipping costs if actual shipment details materially differ from declared information.
8. DELIVERY TIMELINES
8.1. All delivery timelines displayed are estimates only.
8.2. Delays may occur due to: a) Weather conditions b) Customs or regulatory inspections c) Security checks d) Force majeure events e) Operational constraints of the Logistics Provider
8.3. Arya shall not be liable for delays beyond its reasonable control.
9. DELIVERY ADDRESS
9.1. Delivery address cannot be modified once an order has been placed.
10. ESCROW & DELIVERY CONFIRMATION
10.1. Buyer payments are held in escrow upon order placement.
10.2. Funds are released to the Seller only after: i. Buyer confirmation of delivery, or ii. Verified proof of delivery from the Logistics Provider
10.3. Escrow does not constitute insurance and does not replace cargo coverage.
11. INSPECTION & ACCEPTANCE
11.1. Buyers must inspect goods immediately upon delivery.
11.2. Any claims for: i. Damage ii. Shortage iii. Incorrect goods must be reported within the inspection window specified on the Platform.
11.3. Failure to report within this period constitutes deemed acceptance.
12. DAMAGED, LOST, OR MISSING SHIPMENTS
12.1. Where insurance applies: a) Claims are handled by the Logistics Provider b) Arya may assist with documentation and coordination only
12.2. Where insurance was declined: a) The Buyer bears all losses b) Arya has no obligation to compensate or refund
13. CROSS-BORDER SHIPMENTS, CUSTOMS & DUTIES
13.1. Orders may be subject to import duties and taxes
13.2. Buyers are responsible for: a) Import duties b) Taxes c) Regulatory compliance
13.3. Arya does not guarantee customs clearance or timelines.
13.4. Delays or seizures caused by customs authorities are outside Arya's liability.
14. TRACKING
14.1. Tracking details are provided once the order is dispatched.
15. PROHIBITED & RESTRICTED GOODS
15.1. Sellers must comply with all applicable laws and logistics restrictions.
15.2. Arya reserves the right to suspend, cancel, or report shipments that violate regulations.
16. DISPUTE RESOLUTION
16.1. Shipping disputes must be raised through Arya's dispute process.
16.2. Arya may: i. Suspend escrow ii. Request evidence from all parties iii. Issue binding resolutions based on Platform policies
17. LIMITATION OF LIABILITY
17.1. To the maximum extent permitted by law: i. Arya shall not be liable for indirect, incidental, or consequential damages ii. Arya's liability, if any, shall not exceed the platform service fees paid for the transaction iii. Arya shall not be liable for acts or omissions of Logistics Providers
18. AMENDMENTS
18.1. Arya reserves the right to update these Shipping Terms at any time.
18.2. Continued use of the Platform constitutes acceptance of updated terms.
